When the place where the labor contract is performed is inconsistent with the place where the company is registered in China, what is the standard to implement for the treatment of employees?

If the place where the labor contract is performed is inconsistent with the place where the company is registered, the minimum wage standard, labor protection, working conditions, occupational hazard protection and the monthly average wage standard of employees in the region in the previous year shall be implemented in accordance with the relevant provisions of the place where the labor contract is performed.

If the relevant standards of the place where the employer is registered are higher than those of the place where the labor contract is performed, and the employer and the employee agree to implement in accordance with the relevant provisions of the place where the employer is registered, such agreement shall prevail.
