There is a standard leave system in China that every employer in China has to abide by when having working staff in China. Below are some types of leaves explained that your employees can avail..
Public holidays in China
Currently, seven official public holidays are observed in China every year. The detailed holiday periods would be adjusted per year.
Additionally, there are some holidays and memorial days entitled to specific groups of people in China. These are not mandatory leaves. The employer can choose to grant or withdraw these leaves:
International Women’s Day (March 8th), half a day off for women
Youth Day (May 4th), half a day off for youth (youth at or above 14 years old)
Apart from these, the employee may choose to apply for some types of special leave types in China such as follows:
Types of leaves in China
China wedding leave
In China, the marriageable age is 22 years for men and 20 years for women. An employee is entitled to 3 days of wedding leave. Moreover, all legally married couples in Shanghai will be entitled to an additional seven days of marriage leave apart from the three-day national marriage holiday.
China funeral leave
In an event that an immediate relative of the employee (parents, spouse, children) passes away, the employee is entitled to 1 to 3 days of funeral leave.
China family visit leave
Family visit leave can be availed if the immediate family (spouse/parents) do not live together with the employee. In such a case, leave days for a visit to a spouse can be up to 30 days per year and leave days for a visit to parents can be up to 20 days per year (single employees) and up to 20 days per 4 years (married employees).
China sick leave
Sick leave can be availed in case of illness or non-work related injury. The employee shall provide the supporting document for the same issued by a certified practitioner or a recognized medical organization and shall be approved by the employer. The number of annual sick leaves permitted shall be pre-decided and mentioned in the employment contract of the employee. In case of a severe illness, employees in the first year of employment are entitled to a sick leave of maximum 3 months; 1 month of sick leave shall be increased for every next full year, but not more than 24 months totally. China maternity leave
Maternity leave can be used for prenatal examination, childbirth, breastfeeding period, late pregnancy and delivery. The rules are applicable to both first and second child and regardless of age. It is necessary for your benefits administration team to understand the changing policies and rules. Paid annual leave for employees in China
Employee has more than 1 and less than 10 years of cumulative work experience: 5 days annual paid leave
Employee has more than 10 and less than 20 years of cumulative work experience: 10 days annual paid leave
Employee has more than 20 years of cumulative work experience: 15 days annual paid leave
The statutory national holidays and rest days shall not be included in the annual leave.
Although most of these leaves are mandatory, the employer always has the right to grant more leaves or vacations in the company’s policy. However, the employer shall know that once it is recorded in the company’s policy through proper procedure, the stated additional leaves or other benefits will be mandatory.
